1. SCOPE OF APPLICATION
Our Services are intended exclusively for users residing in Switzerland. Therefore, this Policy only applies to the use of the Services by users residing in Switzerland.
Please read this Policy carefully, as it applies to any:
• use of our Services (as defined in the Legal Terms);
• form, material, consent tool, comment, post, and any other content made available through the Services ("Content");
• material you provide or contribute to the Services, including uploads, posts, reviews, disclosures, ratings, comments, chats, etc., made in forums, chat rooms, reviews, or other interactive features associated with the Services ("Contributions").
2. WHO WE ARE
We are Tettamanti & Epper SNC, operating under the trade name Bromqvist (“Company”, “we”, or “our”), a company registered in Switzerland with its registered office at Via Moncucco 35, 6900 Lugano (TI), Switzerland. We operate the website http://www.bromqvist.com (the “Site”), as well as all other related products and services that refer to or link to this Policy (collectively, the “Services”).
3. USE OF THE SERVICES
Access to and use of our Services is permitted only to users who are at least 13 years old. Users who are minors (under 18 years of age) may only use the Services with the consent and under the supervision of a parent or legal guardian.
By using the Services, you agree to comply with this Policy and all applicable Swiss laws and regulations. You also acknowledge that the following is prohibited:
• Systematically retrieving data or other content from the Services in order to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written authorization.
• Making unauthorized use of the Services, including collecting usernames and/or email addresses of other users by electronic or other means to send unsolicited emails, or creating user accounts by automated means or under false pretenses.
• Circumventing, disabling, or otherwise interfering with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or that impose limitations on the use of the Services and/or the Content therein.
• Unauthorized framing of or linking to the Services.
• Deceiving or defrauding us or other users, especially in attempts to obtain sensitive account information (e.g., passwords).
• Misusing our Services, including support services, or submitting false reports of abuse or misconduct.
• Using the Services in an automated manner, such as employing scripts to send comments or messages, or using data mining, robots, or similar data gathering and extraction tools.
• Interfering with, disrupting, or unduly burdening the Services or the networks connected to the Services.
• Attempting to impersonate another user or person, or using another user’s username.
• Using information obtained from the Services to harass, abuse, or harm another person.
• Using the Services as part of any initiative to compete with us, or using the Services and/or the Content for any revenue-generating or commercial endeavor.
• Deciphering, decompiling, disassembling, or reverse engineering any of the software comprising or in any way making up a part of the Services, unless expressly permitted by applicable law.
• Bypassing any measures of the Services designed to prevent or restrict access to the Services or any portion of them.
• Harassing, annoying, intimidating, or threatening our employees or agents engaged in providing any part of the Services.
• Removing copyright or other proprietary rights notices from any Content on the Services.
• Copying or adapting the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
• Uploading or transmitting (or attempting to upload or transmit) viruses, trojans, or other harmful materials — including excessive use of capital letters and spamming — that interfere with anyone’s uninterrupted use of the Services, or that modify, disrupt, impair, alter, or interfere with the use, features, functions, operation, or maintenance of the Services.
• Uploading or transmitting (or attempting to upload or transmit) any material that acts as a passive or active mechanism for the collection or transmission of information, including but not limited to clear GIFs, 1×1 pixels, web bugs, cookies, or similar devices (sometimes referred to as “spyware” or “passive collection mechanisms”).
• Using, launching, developing, or distributing any automated system (except as a result of standard search engine or web browser usage), including, without limitation, spiders, robots, cheat utilities, scrapers, or offline readers that access the Services, or using or launching any unauthorized script or other software.
• Disparaging, tarnishing, or otherwise harming — in our opinion — us and/or the Services.
• Using the Services in a manner inconsistent with applicable laws or regulations.
• Selling or otherwise transferring your user profile to third parties.
• Using a purchasing agent to make purchases on the Services (e.g., buyers or intermediaries acting on behalf of others).
4. CONTRIBUTIONS
For the purposes of this Policy, “Contribution” means:
• any data, information, software, text, code, music, script, sound, graphics, photos, videos, tags, messages, interactive features, or other material that you post, share, upload, submit, or otherwise provide on or through the Services; or
• any other content, material, or data you provide to the Company or use with the Services.
Certain areas of the Services may allow users to upload, transmit, or post Contributions. While we are not obliged to do so, we may review or moderate Contributions posted on the Services. We expressly disclaim any liability for losses or damages arising from user violations of this Policy.
We encourage you to report any Contribution that you believe violates this Policy; however, it is at our sole discretion to determine whether a Contribution indeed violates the Policy.
You represent and warrant that:
• you are the creator and owner of the Contributions you provide or have all necessary licenses, rights, consents, releases, and permissions to use your Contributions and to authorize us, the Services, and other users of the Services to use such Contributions in any manner contemplated by the Services and this Policy;
• all of your Contributions comply with applicable laws and are original and truthful (when representing personal opinions or factual information);
• the creation, distribution, transmission, public display or performance, as well as the access, download, or copying of your Contributions do not infringe any third-party proprietary rights (intellectual or otherwise), including but not limited to copyright, patent, trademark, trade secret, or moral rights;
• you have obtained all necessary consents, releases, and/or permissions, which you can provide upon request, from every identifiable individual featured in your Contributions to use their name or likeness, thereby allowing inclusion and use of the Contributions in any manner contemplated by the Services and this Policy.
You further agree not to post, transmit, or upload any Contribution that:
• violates applicable laws or regulations, judicial orders, contractual obligations, this Policy, our Legal Terms, or any other legal duty; or promotes or facilitates illegal or fraudulent activity;
• is defamatory, obscene, offensive, hateful, insulting, intimidating, harassing, abusive, or threatening toward any person or group;
• is false, inaccurate, or misleading;
• contains child pornography or violates any applicable law on child pornography or the protection of minors;
• solicits personal information from anyone under 18 years old or exploits individuals under the age of 18 in a sexual or violent manner;
• promotes violence, incites the violent overthrow of any government, or encourages, incites, or threatens physical violence against others;
• contains obscene, indecent, lewd, repulsive, violent, harassing, libelous, or defamatory material, or sexually explicit content, or is otherwise unacceptable (as determined at our sole discretion);
• discriminates on the basis of race, gender, religion, nationality, disability, sexual orientation, or age;
• harasses, bullies, humiliates, or insults any person;
• promotes, facilitates, or assists anyone in committing acts of terrorism;
• violates or assists others in violating third-party intellectual property rights, image rights, or privacy rights;
• is deceptive or misrepresents your identity or affiliation with any person, suggesting that the Contribution originates from someone other than yourself;
• contains unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or any other form of solicitation for which compensation (monetary or otherwise) is provided.
5. REVIEWS AND RATINGS
If your Contribution is a review or rating, you additionally agree that:
• you have firsthand experience with the product or service being reviewed;
• your Contribution is truthful and reflects your actual experience;
• you are not affiliated with any competitors when posting negative reviews (nor are you affiliated in any way—such as owner, seller, or manufacturer—with the product or service subject to positive reviews);
• you do not make or offer legal conclusions regarding the conduct of others;
• you do not post false or misleading statements; and
• you do not organize or encourage campaigns to solicit reviews from others (whether positive or negative).
6. REPORTING VIOLATIONS
While we are not obligated to actively monitor user Content or Contributions, we reserve the right to take action in the event of a violation. If you believe a Service, Content, or Contribution violates this Policy or infringes third-party intellectual property rights, please report it to us.
You may contact us by email at info@bromqvist.com, providing details about the material in question and the nature of the violation. We will promptly review your report and reasonably determine whether the reported Service, Content, or Contribution violates this Policy.
7. CONSEQUENCES OF VIOLATIONS
Consequences for violations of this Policy may vary depending on the severity of the offense and the user’s prior conduct on the Services. For example, we may issue a simple warning and/or remove the offending Contribution. However, in the case of serious violations or repeated breaches of our Legal Terms or this Policy, we reserve the right to suspend or terminate your access to our Services and, if applicable, disable your account.
We may also report violations to law enforcement or initiate legal proceedings if we believe there is a real threat to someone or to public safety.
We expressly disclaim any liability for actions we may take in response to user violations of this Policy.
8. COMPLAINTS REGARDING REMOVED CONTENT
If you believe that certain Content or Contributions were removed or blocked from our Services in error, please contact us using the information provided below. We will promptly review the decision to remove or block the reported material.
Please note that during the review process, the Content or Contributions in question may remain unavailable (“offline”).
9. DISCLAIMER OF LIABILITY
Tettamanti & Epper SNC has no obligation to monitor user activity on the Services and disclaims all liability for any misuse of the Services by users.
The Company is not responsible for any Content or Contributions created, published, stored, transmitted, or accessed by users through the Services, nor is it required to monitor or exercise editorial control over such material.
If Tettamanti & Epper SNC becomes aware that any Content or Contribution violates this Policy, it may—besides removing the Content or Contribution and blocking the user’s account—report the violation to the police or relevant regulatory authority.
Unless otherwise stated in this Policy, Tettamanti & Epper SNC disclaims any obligation toward persons who have not entered into a contractual agreement with the Company for the use of the Services.
10. GOVERNING LAW AND JURISDICTION
This Policy is governed exclusively by Swiss law. Any disputes relating to or arising from this Policy fall under the exclusive jurisdiction of the Ordinary Court of Lugano, Switzerland.
